UK Trade Mark Opposition Deadlines: Shorter by one day
This article was included in our Winter 2010 edition of Inside IP magazine.
The UK trade marks registry has reviewed its interpretation of the wording of the trade marks rules in relation to opposition deadlines. Because of the way the rules are worded, the registry has concluded that the opposition deadline is actually ONE DAY SHORTER than it had previously assumed. No change has been made to the calculation of any other deadlines.
If an application is advertised on, for example, 24 September 2010, the registry - and practitioners - had all previously thought that the opposition deadline expired on 24 November 2010 (or 24 December, if extended). That is now incorrect. A UK trade mark application advertised on 24 September would have an opposition period expiring on 23 November 2010 (or 23 December, if extended).
Oppositions which have already been filed are not affected but, from now on, oppositions must be filed within the one day shorter period.
